QUESTIONING
- Be polite… Stay calm… Stop… Don’t run…
No sudden movements… Stay strong, Don’t fold
- Hands out of your pockets
- Name and identification… Give it… Don’t lie or give a fake name
- Do not consent to be searched
- Don’t try to talk your way out… Don’t banter with cops
- DO NOT ANSWER ANY QUESTIONS… DEMAND LAWYER
THE CAR
- License, registration, and insurance… Must be current and kept in car
- Obey traffic laws… Don’t speed; use your turn-signals
- Don’t smoke in your car… Don’t drive high
- Keep car clean… No roaches or paraphernalia
- Use blue tooth… Use seat belts
- Pay parking tickets… No warrants
- Keep your medicine in the trunk
- No guns, no weapons of any kind
WHEN STOPPED
- Turn off your engine
- Open the window… Keep hands exposed
- Don’t throw out anything
- Don’t muck around… No stories, they are looking for an excuse to search
- Be polite: “Officer, if I have committed a traffic offense, give me a citation and I will be on my way”
- Sign the Notice to appear for a traffic ticket
- Do not consent to search your car, your person, or your stuff
- DO NOT ANSWER QUESTIONS… DEMAND LAWYER
THE HOUSE
- Knock Knock… Police! Open the Door!
- Answer the door… No running… No flushing… No suspicious movements
- Comply and be polite
- Ask to see the search warrant… Read the warrant
- Do not consent to let them enter UNLESS THEY HAVE A WARRANT
- Watch out for sneak peek
- Do not resist or obstruct… Let them search
- Ask for a Property List
- DO NOT ANSWER QUESTIONS… DEMAND LAWYER
IF ARRESTED
- Don’t resist… Don’t get angry
- Undercover cops don’t have to tell you they are police
- They don’t have to tell you what you are being arrested for
- DO NOT ANSWER QUESTIONS… DEMAND LAWYER
- Get a phone call… All calls are recorded
- Don’t discuss arrest on phone… Keep it short… Don’t use “code words”
- Stay calm… Try to wait to get OR’d if you can… Save your money
- Get money on your books
- Don’t talk about your case to other inmates… Snitches are listening
- GET A LAWYER
CANNABIS
- Using Medicine?
- Smoking in public… Not smart
- No smoking on federal land
- Keep your doctor’s recommendation and Patient ID card current and valid and with your medicine
- Join a Cooperative
- Cannabis even for medical use is illegal under federal law
LAWYERS
- Talk to them… Listen to them… They want to help you
- Broke? There are lots of good hard working Public Defenders… Respect them
- Plea or jury trial, always use a lawyer
- If convicted, do the time, pay the fine, don’t violate probation, don’t run away, get expungement, pay your taxes
- Stay in touch with your lawyer, don’t act like a jerk
